The ihatecbts.com website and its applications are a hosted service operated by ihatecbts.com ("Service"). Any use of the Service is subject to the following Terms and Conditions of Service ("Terms of Service" or "Terms"), as well as to ihatecbts.com's Privacy Policy, ihatecbts.com's Community Guidelines, and ihatecbts.com's Honor Code, all of which are incorporated by reference into these Terms of Service. Your use of the Service will constitute your acceptance of these Terms of Service.
Eligibility. Use of the Service is void where prohibited. The Service is intended for users over the age of 13, but is open to all ages. For children age 13 or younger (or other age of consent where required by local law), ihatecbts.com offers a restricted feature set and website experience that removes certain features. By using the Service, you represent and warrant that (a) all registration information you submit is truthful and accurate; (b) you will maintain the accuracy of such information; and (c) your use of the Service does not violate any applicable law or regulation.
Your ihatecbts.com Account and Data. If you create an account on the Service, you are responsible for maintaining the security of your account and data, and you are fully responsible for all activities that occur under the account. Accounts are for individual, not organizational, use by a single person only. You may not share your account with any other person. You must notify ihatecbts.com immediately of any unauthorized uses of your data, your account or any other breaches of security. ihatecbts.com will not be liable for any acts or omissions by you, including any damages of any kind incurred as a result of such acts or omissions. ihatecbts.com may from time to time set storage limits for your data, or take any other measures it considers appropriate to manage the Service. ihatecbts.com may also from time to time change its policies on offering commercial content or displaying advertising, and may do this without notice.
Subscriptions. You have the option to purchase a subscription plan, which offers an upgraded experience with additional features or functionality for your ihatecbts.com account ("Subscription"). Subscriptions may be purchased either by (i) paying a recurring subscription fee; or (ii) pre-payment giving you access for a specific time period ("Pre-Paid Period"). The terms stated below will govern your participation in these programs.
Pre-Paid Subscription Term: Subscriptions purchased for a Pre-Paid Period will automatically terminate at the end of the Pre-Paid Period.
Group Orders: A Group Order provides discounted credits towards multiple, individual Pre-Paid Period Subscriptions via a unique upgrade link. You may select the number of subscription credits you would like to purchase. Purchasers of Group Orders are solely responsible for the distribution of subscription credits. All subscriptions are non-transferable and irrevocable once a credit has been redeemed by an individual user account. Individual accounts which use a Group Order subscription credit may not be associated with any school, business, entity, institution or any other centralized account and the purchaser of the Group Order has no right to or interest in any account to which a subscription credit has been applied, except where the purchaser of the Group Order and the holder of the account to which a subscription credit has been applied are the same individual.
To Cancel Your Subscription: You may cancel your Subscription at any time. If your Subscription is set to automatically renew, you must cancel at least 1 day prior to the expiration of the Subscription term in order to avoid additional charges. You may continue to enjoy yourSubscription benefits until that date, after which your Subscription will terminate and your account will automatically downgrade. You can cancel your Subscription in your account settings. Our cancellation policy can be found on our website.
Cancellation by Us: We may cancel your Upgraded Membership at any time for any reason, with or without prior notice.
Refunds: Except where required by law, Subscriptions purchased directly through ihatecbts.com are non-refundable. Subscriptions purchased through other platforms are subject to the refund policies of those platforms. ihatecbts.com cannot be held responsible for these platforms' policies. We do not provide any refunds if the price for Subscription plans drops, or if we offer subsequent promotion pricing or change the content or features of the Service.
Price changes: We may change the price for Subscriptions from time to time. We will communicate any price changes to you in advance. Price changes for Subscriptions will take effect on the next renewal date following the date of the price change. As permitted by local law, you accept the new price by continuing to maintain your Subscription after the price change takes effect. If you do not agree with the price changes, you have the right to reject the change by canceling from the Subscription prior to the price change going into effect. Please be sure to read any such notification of price changes carefully.
Premium Content: Users may have the option to purchase or gain access to commercial content on ihatecbts.com (“Premium Content”). Access to Premium Content may be granted either by (i) purchasing access directly on the Service (“Content Subscription”); or (ii) entering an access code (“Access Code”). The terms stated below will govern your participation in these programs.
Content Subscriptions: Access to Premium Content purchased as part of a Content Subscription is subject to the terms set forth during the purchase process and you are bound by the restrictions included.
Access Codes: Access to Premium Content through use of a publisher-provided Access Code is subject to the terms set forth by the publisher and you are bound by the publisher’s restrictions, including expiration of codes.
License: Once you have purchased a Content Subscription or used an Access Code to access Premium Content, you may access the included material for the designated period of time. You may access the Premium Content only for your own personal, educational use (“Personal Use”). Each account must purchase its own Content Subscription or enter its own Access Code, and accounts may not be shared by multiple users.
Restrictions: You may not use Premium Content for any commercial purpose. This means you can’t sell it, use it for advertising or marketing purposes, or use it in any other way in connection with a business or profit making activity. You may not post or otherwise make the Premium Content available on any website. You may not share, send, sell, sublicense, or transfer the Premium Content to someone else.
Refunds: Except where required by law, Premium Content Subscriptions purchased directly through ihatecbts.com are non-refundable. Premium Content Subscriptions purchased through other platforms are subject to the refund policies of those platforms. ihatecbts.com is not responsible for the policies of those platforms.
Responsibility of Contributors. If you create sets, comment via the discussion boxes, post material to the Service, post links on the Service, or otherwise make material available by means of the Service (referred to collectively as "Content") you are entirely responsible for the composition of, and any harm resulting from, that Content. That is the case, regardless of whether the Content in question constitutes text, graphics, audio files, computer software or any other format in which ihatecbts.com stores data.
Prohibited Content. You may post only educational and study-related Content to the Service. The following are examples of Content prohibited to post on or through the Service.ihatecbts.com reserves the right to investigate and take appropriate legal action against anyone who, in ihatecbts.com's sole discretion, violates this provision, including without limitation, removing the offending Content from the Service, limiting the use of any portion of the Service or terminating the accounts of such violators, or seeking other legal remedies. Prohibited Content includes, but is not limited to, Content that, in the sole discretion of ihatecbts.com:
is patently offensive and promotes racism, bigotry, hatred or physical harm of any kind against any class or individual;
harasses or advocates harassment of another person;
exploits people in a sexual or violent manner;
contains sexually suggestive, excessively violent, or offensive subject matter;
solicits personal information from anyone under 18 years old;
publicly posts information that poses or creates a privacy or security risk to any person;
includes information about another person that you have posted without that person's consent;
violates the privacy rights, publicity rights, copyrights, trademark rights, contract rights or any other rights of any person;
contains or promotes information that you know is false or misleading, or promotes illegal activities or conduct that are abusive, threatening, obscene, defamatory or libelous;
contains or promotes an illegal or unauthorized copy of another person's copyrighted work;
solicits passwords or personally-identifying information for commercial or unlawful purposes from other users;
involves the transmission of junk mail, chain letters, unsolicited mass mailings or instant messages, or spam;
furthers or promotes any criminal activity or enterprise, or provides instructional information about illegal activities including, but not limited to, making or buying illegal weapons, violating someone's privacy, or providing or creating computer viruses;
involves commercial activities and/or sales without prior written consent from ihatecbts.com, such as contests, sweepstakes, bartering, advertising, or pyramid schemes;
violates any and all applicable laws or regulations.
Prohibited Activities. You may only engage in educational and study-related activities while using the Service. The following are examples of the kind of activity that is prohibited on the Service. ihatecbts.com reserves the right to investigate and take appropriate legal action against anyone who, in ihatecbts.com's sole discretion, violates this provision, including without limitation, terminating your account and/or access to the Service, reporting you to appropriate governmental authorities, including law enforcement, or seeking other legal remedies. Prohibited activity includes, but is not limited to:
criminal or tortious activity, including child pornography, fraud, trafficking in obscene material, drug dealing, gambling, harassment, stalking, spamming, sending of viruses or other harmful files, copyright infringement, patent infringement, or theft of trade secrets;
circumventing or modifying, attempting to circumvent or modify, or encouraging or assisting any other person in circumventing or modifying any security technology or software that is part of the Service;
impersonating or attempting to impersonate another user, person or entity;
using the account, username, or password of another user at any time, or disclosing your password to any third party, or permitting any third party to access your account;
using any information obtained from the Service in order to harass, abuse, or harm another person or entity, or attempting to do so;
activity that involves the use of viruses, bots, worms, or any other computer code, files or programs that interrupt, destroy or limit the functionality of any computer software or hardware, or otherwise permit the unauthorized use of, or access to, a computer or a computer network;
any automated use of the system, such as, but not limited to, using scripts to create or post Content;
interfering with, disrupting, or creating an undue burdenon the Service or the networks or services connected to the Service;
attempting to impersonate a ihatecbts.com employee, agent, or third party applications (like bots);
selling or otherwise transferring your profile;
using any information obtained from the Service in order to harass, abuse, or harm another person;
using the Service in a manner inconsistent with any and all applicable laws and regulations;
using the Service to advertise or sell goods and services;
using the Service to send unsolicited emails;
using the Service to engage in any data mining, data harvesting, data extracting or any other similar activity in relation to this Website, or while using this Website;
using this Website to engage in any advertising or marketing activities.
Copyright Infringement and DMCA Policy. As ihatecbts.com asks others to respect its intellectual property rights, it respects the intellectual property rights of others. If you believe that material located on or linked to by ihatecbts.com violates your copyright, you are encouraged to notify ihatecbts.com. ihatecbts.com will respond to all such notices, including as required or appropriate by removing the infringing material or disabling all links to the infringing material. ihatecbts.com will terminate a visitor's access to and use of the Service if, under appropriate circumstances, the visitor is determined to be a repeat infringer of the copyrights or other intellectual property rights of ihatecbts.com or others.
Intellectual Property. This Agreement does not transfer from ihatecbts.com to you any ihatecbts.com or third party intellectual property, and all right, title, and interest in and to such property will remain (as between the parties) solely with ihatecbts.com. ihatecbts.com, the ihatecbts.com logo, and all other trademarks, service marks, graphics and logos used in connection with ihatecbts.com, or the Service are trademarks or registered trademarks of ihatecbts.com or ihatecbts.com's licensors. Other trademarks, service marks, graphics and logos used in connection with the Service may be the trademarks of other third parties. Your use of the Service grants you no right or license to reproduce or otherwise use any ihatecbts.com or third-party trademarks.
Changes. ihatecbts.com reserves the right, at its sole discretion, to modify or replace any part of this Agreement. It is your responsibility to check this Agreement periodically for changes. Your continued use of or access to the Service following the posting of any changes to this Agreement constitutes acceptance of those changes. ihatecbts.com may also, in the future, offer new services and/or features through the Service (including, the release of new tools and resources). Such new features and/or services shall be subject to the terms and conditions of this Agreement.
Termination. ihatecbts.com may terminate your access to all or any part of the Service at any time, with or without cause, with or without notice, effective immediately. If you wish to terminate this Agreement or your ihatecbts.com account (if you have one), you may simply discontinue using the Service. All provisions of this Agreement which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.
Disclaimer of Warranties. The Service is provided "as is". ihatecbts.com and its suppliers and licensors hereby disclaim all warranties of any kind, express or implied, including, without limitation, the warranties of merchantability, fitness for a particular purpose and non-infringement. Neither ihatecbts.com nor its suppliers and licensors, makes any warranty that the Service will be error free or that access thereto willbe continuous or uninterrupted. You understand that you download from, or otherwise obtain content or services through, the Service at your own discretion and risk.
Limitation of Liability: ihatecbts.com, its suppliers, and licensors are not responsible for any kind of damages (direct, indirect, special, consequential, or exemplary) that may occur from using their service. This includes any damages from hyperlinked websites. Even if they've been warned about potential damages, they're not liable. The most they might owe you is the amount you've paid them in the last 12 months. Some places might not allow such limitations, so this might not apply to you.
Disputes: If you have a problem with ihatecbts.com, it will be settled through binding arbitration, not in court. This will be done by the American Arbitration Association (AAA) following their rules. You'll have to pay any fees associated with this. The decision made through arbitration is final. You won't have a judge or jury, and you can't appeal the decision. You and ihatecbts.com agree to give up the right to a court trial.
Disputes will be settled individually: You and ihatecbts.com agree to give up the right to participate in a class action or arbitration. If needed, each party can seek legal relief in San Francisco County to protect their intellectual property rights.
Governing Law: The laws of California, USA, govern these terms of service and any access to or use of ihatecbts.com, regardless of where you are located in the world.
Venue: Any dispute subject to Binding Arbitration will take place in San Francisco County, California. For any other judicial action that may arise between you and ihatecbts.com, both you and ihatecbts.com agree to submit to the venue and personal jurisdiction of the state and federal courts located in San Francisco County, California.
General Representation and Warranty: You promise that your use of the service will be in accordance with ihatecbts.com's Privacy Policy, these Terms of Service, any applicable laws and regulations, and any other applicable policy or terms and conditions.
Indemnification: You agree to defend, indemnify and hold harmless ihatecbts.com, its contractors, and its licensors, and their respective directors, officers, employees and agents from any claims and expenses, including attorneys' fees, arising from your use of the Service.
Severability: If any part of these Terms of Service is held invalid or unenforceable, that part will be interpreted to reflect the original intent, and the remaining parts will still be valid.
Non-waiver of Rights: If either party waives any term or condition of these Terms of Service or any breach thereof, it will not waive any future breaches.
Assignment: You may assign your rights under these Terms of Service to any party that agrees to its terms. ihatecbts.com may assign its rights under these Terms of Service without condition.
Survival of Terms: These Terms continue to apply, even after you close your account or stop using the Service.
